Item 1.Every job that receives an official quotation has a website URL link to this page and is covered by these Ts&Cs;

Item 2.All quotations are provided free of charge (except in cases described in Item 14 & 26) and the customer is under no obligation to go ahead with any of the work requested/proposed;

Item 3.Customers may add/omit any aspects of the job to meet their budget and expectations. Please simply state which items (A to Z) should be omitted from the job;

Item 4.Approval of a quote constitutes the commencement of a contract between the customer and Upcycle Interiors Limited (UIL), approval can be verbal or written (email, SMS, etc);

Item 5.If a job is cancelled after it is approved by the customer, the customer may still be liable for costs incurred (even if work has not begun on site) for items such as: materials purchased in advance, specialist tools purchased specifically for the job, mobilisation, scheduling, project management, design, administration, etc;

Item 6.All quotations are contractual and guarantee a fixed price to the customer;

Item 7.Unless otherwise stated in the quotation, the price stated is for onsite work conducted during normal working hours which are 8am – 4pm, Monday – Friday. Evenings and weekends are charged at 200% unless agreed otherwise;

Item 8.If noisy works are required outside of normal hours (Monday to Friday: 8am to 6pm, Saturdays: 8am to 1pm, Sundays and bank holidays no noisy work permitted), it is the customers responsibility to check any party wall agreements (and agree this in advance with neighbours), the community, building control, the planning department, local council, etc;

Item 9.Where works have to be halted or delayed, due to client fault (site is not ready, variation to the works, lack of information, delay with client supplied goods/materials) , UIL will be entitled to make a delays claim. Labour rates start at £120 per half day (rounded up) of delay. Costs of materials, delivery, travel, redesign, scheduling, and administration may also need to be added. Delays claims cannot be brought for adverse weather, floods, force majeure, national strikes, civil commotion, or terrorism;

Item 10.Off site availability (phone, email, etc) is 8am – 8pm, Monday – Sunday;

Item 11.All quotations are valid for 30 days, after which Upcycle Interiors Limited (UIL) has the right to review and amend where necessary;

Item 12.No VAT is payable;

Item 13.The default non-refundable deposit of 10% is to be paid in advance of all jobs (unless otherwise stated in the quotation), this is to mitigate against cancellations;

Item 14.UIL does not provide free property maintenance reports or a property inspection service. Therefore, all quotations provided to landlords for tenanted properties will require a £50 non-refundable deposit to be paid in advance of the quotation being provided. Should the job go ahead, this amount will be deducted from the final balance. If the customer decides not to go ahead with any work the £50 fee will be retained by UIL as payment for providing the detailed quotation of works and time spent visiting the property. Any jobs that do go ahead will also require the default 10% deposit (or more if stated in the quote) to be paid to secure the job;

Item 15.Payment of the deposit secures the start date of the job;

Item 16.The remaining balance is due on the same day as completion, either by cash or direct bank wire transfer (bank details can be found on the quotation/invoice);                 

Item 17.Some larger jobs will have phases whereby payment is required on completion of each phase (AKA staged payments), this will be fully detailed in the quotation;

Item 18.Late payments incur the daily statutory interest rate of 8% + BoE base rate ÷ 365 (BoE - Bank of England);

Item 19.All additional work (that is, not stated in the quotation) undertaken will incur extra costs, this will be discussed and agreed with the customer before it goes ahead. An updated or new quote will be issued for the extra work;

Item 20.UIL generally does not subcontract work (but do reserve the right to subcontract work if necessary). Any work carried out by other tradespeople or businesses should be paid directly to said businesses. UIL cannot receive money for services provided by others;

Item 21.All work is insured, policy details are available upon request;

Item 22.In the unlikely event that the customer is unhappy with the work provided by UIL, UIL must be given the opportunity to rectify the problem before negative feedback/reviews are posted online;

Item 23.UIL may use photos of your project for marketing purposes, this includes publication online.  Please advise if you don't want photos of your project published online;

Item 24.All goods remain the property of Upcycle Interiors Ltd until payment in full is received;

Item 25.These Ts&Cs do not affect your statutory rights;

Item 26.Quotations provided for work on properties where the customer is currently in the viewing or conveyancing process and has not completed or taken ownership yet are subject to a £50 non-refundable deposit to be paid in advance of UIL viewing the property. Should the job go ahead, this amount will be deducted from the final balance. If the customer decides not to go ahead with any work or the purchase of the property does not complete the £50 fee will be retained by UIL as payment for time spent viewing the property and potentially providing any detailed quotations for work. Any jobs that do go ahead will also require the default 10% deposit (or more if stated in the quote) to be paid to secure the job;

Item 27.UIL will not be held financially liable for any non-negligent damage caused whilst conducting the work requested by the customer;

Item 28.UIL has public liability insurance cover for any damage to property or injury to persons caused by negligence, details are available upon request;

Item 29.These Ts & Cs and any contract brought into being as a result of a signed quotation or paid deposit are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English;

Item 30.Payment of a deposit to UIL is deemed to be acceptance of these Ts&Cs;

Item 31.Where the customer accepts a discount (even if the value of the discount is £0.00) for a ‘Corex advertising sign fixed to your wall’, the sign must remain in place and visible for a minimum term of 12 months after UIL has completed the job. The sign is the property of UIL, if the customer wishes for the sign to be removed after the 12 months please return it to UIL;

Item 32.Late payments will be charged a fixed sum in addition to the daily interest (see Item 18) as follows: Amount of debt- up to £999.99 fee = £40; Amount of debt- £1,000 to £9,999.99 fee = £70; Amount of debt- £10,000 or more fee = £100;

Item 33.In addition to the fixed sum late payment fee (Item 32) and daily interest (Item 18) late payments will be charged reasonable costs for the administration time spent each time the debt recovery is attempted. This will be charged at £25 per hour;

Item 34.For jobs at properties where parking spaces are limited/restricted the customer will be responsible for making prior arrangements to park 1 vehicle for the duration of the job;

Item 35.Where parking spaces cannot be booked or reserved by the customer for use by Upcycle Interiors Limited and Upcycle Interiors Limited receive a parking fine the customer will be responsible to cover the cost of the fine +25% additional cost for administration time;

Item 36.UIL agree to complete the Works carefully and competently;

Item 37.UIL will take all reasonable steps to minimise health and safety risks to themselves, agents, the Customer and others;

Item 38.UIL will take all reasonable steps to minimise environmental damage;

Item 39.UIL agree to store away any tools or equipment used at the end of each working day and ensure that any temporary protection for the Works is safe and weatherproof;

Item 40.UIL will give the site a basic 'builders clean' after completing the works, at the end of the project

Item 41.The customer will take notice of all safety warnings given by UIL;

Item 42.The customer will follow any reasonable instructions given by UIL in respect of the Works being carried out;

Item 43.The customer will not allow any unauthorised persons (including children) to access the site during work times;

Item 44.The customer will give UIL access to the Site during the agreed working hours throughout the working period;

Item 45.The customer will not obstruct UIL and will keep the Site clear of obstructions to allow UIL to carry out the Works;

Item 46.Both parties (UIL and the customer) expressly agree that they do not rely on any representations made before this Agreement was formed;

Item 47.The rights and remedies provided under this Agreement are in addition to the Customer’s consumer rights;

Item 48.All goods/materials/documents/drawings/information remain the property of Upcycle Interiors Ltd until payment in full is received;

Item 49.Any goods/materials delivered to site but not yet installed are the property of Upcycle interiors Ltd;

Item 50.The customer is responsible for site security, this includes the safekeeping of materials delivered to and stored on site which are/are not yet installed and are still the property of UIL;

Item 51.Work will be built in a good and workmanlike manner, with reasonable care and skill and it will be sufficiently free of any major defects;

Item 52.Where UIL does not receive payment in full the customer will not take ownership of the goods(materials) and services provided;

Item 53.Where UIL does not receive payment in full, UIL will not be obliged to carry out any repairs, fix any defects or correct any errors. The work will not be covered by any guarantee or warranty;

Item 54.A payment is considered to be ‘late’ after 30 days from the date the invoice was sent, unless the invoice states a deadline for payment to be received;

Item 55.Sources of water and electricity will be furnished in reasonable quantities for use in lighting, for portable power tools, as drinking water, as water for testing and other such common uses during construction, without cost to UIL. UIL shall make all connections, furnish any necessary extensions and remove all connections and extensions upon completion of the work;
